Description of the objective

Administrative monetary penalties are one of several enforcement options for CFIA to respond to non-compliance. The proposed amendments to Part XII (transportation of animals) of the Health of Animals Regulations require that consequential amendments be made to Schedule 1, Part 1, Division 2 of the Agriculture and Agri-Food Administrative Monetary Penalties Regulations to address animal transportation violations.

The objective of this proposed amendment is to allow administrative monetary penalties to be issued for violations of the provisions of Part XII of the Health of Animals Regulations. These provisions relate to the protection of animal welfare, which is important to the social, economic, and physical well-being of Canadians.

These amendments would also address several outstanding concerns identified by the Standing Joint Committee for the Scrutiny of Regulations. These include updating and clarifying certain provisions Schedule 1, Parts 1 and 2 of the Agri-Food Administrative Monetary Penalties Regulations.

Potential impacts on Canadians, including businesses

There are no business impacts or direct costs expected as a result of the proposed regulatory amendment.

The CFIA intends to propose a delay to the coming into force for the amendments to the Health of Animals Regulations, Part XII. These regulations will come into force one year from their publication in Canada Gazette, Part II. The amendments to the Administrative Monetary Penalties Regulations will adhere to the same timeline.

Regulatory cooperation efforts (domestic, international)

This initiative is a companion amendment to the humane transportation initiative, below. Regulatory cooperation is not applicable in this context.
