Questions and answers for the amendments to the Health of Animals Regulations (Animal Disease Zoning)

What is the purpose of the regulatory amendments?

The amendments to the Agriculture and Agri-Food Administrative Monetary Penalties Regulations and the Compensation for Destroyed Animals Regulations provide the Minister of Agriculture and Agri-Food with the authority to issue notices of violation. They also provide authority to grant compensation for disposal cost for animals ordered destroyed under the zoning provisions of the Act as per maximum amounts for the compensation that may be ordered for the destroyed animals.

These amendments, along with changes to the Health of Animals Regulations, are a result of changes that were made to the Health of Animals Act in 2012 that introduced a new zoning framework.

When will the amendments be implemented?

The amendments were published in Canada Gazette, Part II on May 1, 2019 and are now in effect.

How do the amendments affect Canadian businesses?

The amendments have no new requirements, economic impact or direct costs.

Why are these amendments being made?

These amendments align the legislative framework for animal health with respect to zoning introduced. Notices of violation and administrative monetary penalties (AMPs) are important enforcement measures to encourage compliance with regulations and reduce risks associated with federally regulated animal diseases. The amendments to the Agriculture and Agri-Food Administrative Monetary Penalties Regulations are necessary to allow notices of violations to be issued for violations of the zoning provisions that were added to the Act.

Compensation is an important part of CFIA's efforts to control and eradicate animal diseases that threaten Canada's livestock population and helps promote compliance by reducing the economic impact. The amendments to the Compensation for Destroyed Animals Regulations are necessary to allow compensation to be paid for the costs of disposal of animals ordered disposed of under the Zoning provisions and to set maximum amounts for the compensation that may be paid for those destroyed animals.
