Regulations amending the Health of Animals Regulations, Part XV (Livestock identification and traceability)

Description of the Objective

Animal traceability is the ability to follow an animal or group of animals through all stages of its life. This regulatory proposal would amend Part XV of the Health of Animal Regulations (HAR) to include mandatory animal identification and movement reporting requirements for cattle, bison, sheep, pigs, goat, and cervid species thereby broadening the scope of activities and animals that are subject to traceability requirements.

The principal movement reporting requirement would be that when an animal is moved from one site to another, the operator of the destination site would be required to report the receipt of the animal to the Responsible Administrator. The operator of the destination site would also be required to report the identification numbers of the departure and destination site, the date and time that the conveyance left the departure site, the identification numbers on the approved indicators applied to the animals, and the licence plate number of the conveyance used to transport the animals.

By requiring more complete and accurate traceability information, this regulatory proposal would enable more effective and timely response to disease outbreaks, food safety issues and natural disasters; and would better support disease surveillance activities.

The benefits would be enhanced protection of animal health and public health; protection of the livelihood of the meat and dairy value chains, and; contribution in reducing risks of economic loss and market disruptions.

The regulatory proposal would reduce regulatory differences and increase regulatory compatibility with provincial and territorial governments who have adopted livestock identification and movement reporting requirements. Having a traceability system for animals contributes to food safety outcomes from a gate-to-plate perspective.

In addition, the proposed amendments would address several concerns and recommendations raised by the Standing Joint Committee for the Scrutiny of Regulations.

There would be business impacts. The "One-for-One" Rule and the Small Business Lens would apply. The CFIA is currently conducting these analyses.

Public Consultation Opportunities

The CFIA conducted two rounds of public consultations; the first in 2013, and the second in 2015. Engagement activities were targeted towards national and provincial industry associations (representing bison, cattle, sheep, goat, deer, elk and pork producers), associations representing intermediate and terminal sites, and provincial/territorial governments. Consultations have been on-going with Agriculture and Agri-Food Canada, and provincial and territorial governments, who are generally in agreement with the regulatory proposal and continue to provide input on proposed requirements and implementation.

It is anticipated these proposed amendments will be pre-published in the Canada Gazette, Part I in Spring 2018. A public comment period of 75 days will be available for Canadians and other interested parties to provide feedback on the regulatory proposal.
