In order to be compliant with the Service Fees Act (SFA), the Canadian Food Inspection Agency (CFIA) will begin adjusting its fees based on the Consumer Price Index (CPI) starting March 31, 2020, and on every March 31 going forward.

The current Fees Notice has amendments which came into force, January 15, 2019.

About the consultation

The Safe Food for Canadians Act brings with it a new licensing regime and related costs along with the repeal of the old food statutes. The Canadian Food Inspection Agency (CFIA) was seeking feedback on proposed changes to certain parts of the CFIA Fees Notice to implement the licensing regime and align the Notice with the language and authorities in the Safe Food for Canadians Act and Regulations. These changes are not related to the cost recovery initiative that the CFIA consulted on from January to April 2017. The CFIA launched a consultation from July 25, 2018 to September 7, 2018 in order to gather comments on the proposed changes.

No changes to monetary values were being proposed with 2 exceptions:

All changes relate to new wording and authorities found in the Safe Food for Canadians Act and Regulations.

The CFIA was seeking feedback on proposed changes to the following parts the Notice:

The proposed changes that were the subject of this consultation are not related to the cost recovery initiative that the CFIA consulted on from January to April 2017. These changes are intended to implement the Safe Food for Canadians Act and Regulations, coming into force on January 15, 2019, by aligning the Notice with the language and authorities found in the new legislation. The changes are intended to have minimal impacts to stakeholders.

Changes fall into the following 3 main categories:

Category 1: Updates to wording and references, by replacing language and references taken from existing Acts and Regulations with the wording and references found in the Safe Food for Canadians Act and Regulations. Wording and reference updates will not impact services or costs to stakeholders.

Category 2: In instances where authorities no longer exist for the CFIA to continue a service, these services and their associated charges are proposed for deletion. For example, for fresh fruit and vegetables, the costs associated with a release permit and inspection of produce at the point of shipping for the purpose of interprovincial trade have been removed.

Category 3: Addition of the SFCR licence in all food commodities and conversion of any existing establishment registration charges (where applicable) into charges for establishment inspections. For those who previously paid for registrations, the charge for inspection would be invoiced in full, following the first inspection that takes place in each year the licence is valid.
